Tiny Homes into the International Residential Code | Pangea Builders

The mainstreaming of affordable and energy-efficient small and tiny homes into our cultural consciousness has picked up tremendous momentum in the last few years, leading many to characterize it as a movement in its own right. Even though tiny homes won’t be a fit for everyone, they could potentially help address critical issues like over-consumption and debt, while growing alternative and more sustainable building practices on a larger scale and making housing more affordable.

But the idealism of the movement has usually come up against the restrictive realitiesof existing zoning and building regulations. In many places, tiny homes exist in a legal gray area of sorts, on top of the fact that there are no widely agreed-upon safety standards for them, making it difficult for wider integration.

Things are slowly changing though. Tiny House Build’s Andrew Morrison (previously here and here) is spearheading a proposed appendix to be added to the 2018 International Residential Code (IRC), which will address “ceiling heights, sleeping lofts, loft access, emergency escape and egress, and many other details”.

Morrison relates some of the backstory leading up to their journey to the International Code Council’s public comment hearing this weekend in Kansas City, and explains why having some kind of tiny house building standard is important at this juncture:

As you know, I am a firm believer in the need for codes when it comes to construction having been a building professional for over 20 years. Over the years, I have seen construction that is sub par (even WAY sub par in some cases). This is simply not an option for our tiny houses because they have the added stress of road forces such as wind, road rattle (potholes), deceleration, and more. It’s not just a simple house on a foundation anymore.

I am aware that not everyone believes in building codes. The reality is that areas that enforce building codes require any house within that area to meet those codes. If you don’t like codes, there is nothing wrong with building in areas that do not have them to enforce. If, however, you want to live in an area that does have code enforcement, this proposed tiny house code appendix (if approved) will allow you to legally build your tiny house to code and to receive a certificate of occupancy.
Morrison notes, however, that the proposed appendix “would not impact those who build Tiny House RVs under RVIA standards as those are governed separately from the IRC” and explains elsewhere why it’s better anyway to have tiny homes legally considered as permanent residences rather than RVs. In any case, this proposal is already a huge step forward to further legitimizing tiny homes, potentially providing builders and homeowners with some guidelines on how making them safer and easier to build.

It’s late in the game, but you can also lobby your local officials who are voting members in the ICC, says Morrison: “Please contact your local building departments and find out who is a voting member of ICC. Ask them to support the proposal with their vote. I believed they can vote electronically without attending the hearings, so it should be easy for them. Let them know that this proposal provides safe solutions to the difficult question of what to do with tiny houses. The more votes of support we have from ICC members, the better.”

Carpenter and home builder here (recently retired)! During by career I personally built well over a hundred conventional homes in Jackson County, MO: You can tour neighborhoods I (and my crews) built. Since the 80s we (actual) home builders have been trying to get the masses to see that homelessness has nothing to do with the actual cost of building a home. The inflated cost of home, has only to do with money-empowered people, who buy-up the products of the hands-on home builders, and inflating the price to make a cut, forwarding those costs (typically) onto the next generation, in the form of a 30 year mortgage. We who actually work, call these kind, the sedentary capitalistic do-nothings; the hands-in-the-pie takers; trump’s (yep, we were saying that 2 decades ago); barnacles; parasites; those whose life motto is: I am, therefore I am owed!

All the land in North America cost zero dollars for 99% of human existence, up until capitalism was legalized and then (over time) normalized; where something that costs nothing, was issued a dollar value, so that the profiteer can make money doing nothing at all; be it the land, or the house, (or whatever). They simply step-in as a go-between to take a cut, simply for existing. Over a few dozen generations, they have managed to drive the price of everything so high that those who actually build homes, cannot afford Home. It is analogous to the lone farmer who has 20 million people surrounding his farm, waiting for him to produce all the food, and when its ready, they step-in and take a cut: It’s the cut-taker phenomenon!

But no alternatives to building is necessary, once you remove the many people, who do not physically build homes, thus limiting the cost to only raw materials and labor (which could be you). But the city (or county or municipality) wants their cut too; they require that you pay them to build a home (permits, inspections, taxes, etc.); they require you to hook-up to their network systems (water, sewer, electricity, gas, communication, etc.). A safe, sturdy, simple (288sf) self-contained shelter is relatively inexpensive to build; it is all the other people awaiting their cut that makes Home such a monumental issue.




This will make self-built tiny houses impossible. The builders want in, and they want to jack the prices way, way up. Either you buy an RV-appropriate house with all the expensive hookups for a trailer park, or you will have to hire a builder and pay fifty to a hundred grand. No back-yarders anymore. This slams the status quo into law with no back doors.

The “danger” in a self-built tiny house attaches to the person living there. They want to make that person safe by making sure they can’t build one for less than 50-100 grand. So safe they’ll have to keep renting at more than 50% of their net income. If they’re allowed to; percentage of net income is now a requirement in my city. 35% of net is the figure on the advertisements. So, no poors.

This might be the end, not just here, but everywhere in the world. This makes such tiny houses as we have made illegal.

The purpose is, as I’ve made clear, to make it impossible for poor people to build a house and live where the well-off can see them, feel them, or even imagine them existing. The comment threads and interviews with people who are speaking plainly make that damned clear. No poors allowed.
